Participant Information

1. ACKNOWLEDGMENT OF VOLUNTARY PARTICIPATION

I understand that I am voluntarily participating in a Boom Well, LLC event (Details listed above) I acknowledge that participation may include physical activities, wellness exercises, movement, fitness activities, educational presentations, group discussions, outdoor activities, recreational activities, or other event-related experiences.

I understand that participation is voluntary and that I may discontinue participation at any time.

2. ASSUMPTION OF RISK

I acknowledge that participation in the Event involves inherent risks, including but not limited to:

• Slips, trips, and falls

• Physical exertion and fatigue

• Muscle strains, sprains, or other injuries

• Exposure to weather conditions

• Equipment-related injuries

• Allergic reactions

• Illness or medical emergencies

• Risks associated with travel to and from the Event

I knowingly and voluntarily assume all risks, known and unknown, associated with my participation.

3. HEALTH ACKNOWLEDGMENT

I represent that I am physically and mentally capable of participating in the Event.

I understand that Boom Well, LLC, its owners, employees, contractors, speakers, coaches, volunteers, sponsors, and affiliates are not physicians, medical providers, therapists, nutritionists, or mental health professionals unless specifically disclosed.

I understand that any information presented during the Event is for educational and informational purposes only and is not intended to diagnose, treat, cure, or prevent any medical condition.

I agree to consult my physician or other qualified healthcare provider before participating if I have any medical concerns or conditions.

4. RELEASE OF LIABILITY

To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless Boom Well, LLC, its owners, officers, employees, contractors, agents, volunteers, sponsors, presenters, affiliates, successors, and assigns (collectively, the "Released Parties") from any and all claims, demands, liabilities, damages, actions, causes of action, costs, and expenses arising from or related to:

• My participation in the Event;

• Personal injury;

• Property damage;

• Illness;

• Disability;

• Death; or

• Any loss or damage suffered during or relating to the Event.

This release applies whether caused by negligence or otherwise, except where prohibited by applicable law.

5. EMERGENCY MEDICAL TREATMENT

I authorize Boom Well LLC representatives to obtain emergency medical care on my behalf if deemed necessary during the Event.

I understand that I am solely responsible for any medical expenses incurred and that Boom Well LLC does not provide medical insurance coverage for participants.

6. PHOTO, VIDEO & TESTIMONIAL RELEASE

I grant Boom Well, LLC permission to photograph, record, videotape, livestream, and otherwise capture my participation in the Event.

I authorize Boom Well to use such photographs, recordings, testimonials, and likenesses for promotional, educational, marketing, social media, website, advertising, and business purposes without compensation.

I understand that Boom Well may use these materials indefinitely and without further approval.

7. EVENT REGISTRATION, CANCELLATIONS & REFUNDS

Unless otherwise stated in the Event registration materials:

• Registration fees are non-refundable.

• Tickets may not be transferred without prior written approval from Boom Well.

• Boom Well reserves the right to cancel, postpone, modify, or reschedule the Event due to circumstances beyond its reasonable control.

• If Boom Well cancels an Event, participants may receive a refund or credit at Boom Well's discretion.

8. PARTICIPANT CONDUCT

I agree to conduct myself in a respectful and appropriate manner throughout the Event.

Boom Well reserves the right to remove any participant whose behavior is disruptive, unsafe, unlawful, harassing, intoxicated, or otherwise inappropriate. No refund will be issued in such cases.

9. INDEMNIFICATION

I agree to indemnify and hold harmless the Released Parties from any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys' fees, arising from my actions, negligence, misconduct, or violation of Event rules.

10. NO GUARANTEES

I understand that Boom Well makes no guarantees regarding any outcomes, results, health improvements, business success, personal development, or other benefits that may be discussed or promoted during the Event.

Individual results vary and depend on numerous factors beyond Boom Well's control.

11. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona.

Any legal proceeding arising from this Agreement shall be brought exclusively in Pima County, Arizona.

12. SEVERABILITY

If any provision of this Waiver is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13. ENTIRE AGREEMENT

This Waiver constitutes the entire agreement between the participant and Boom Well, LLC regarding participation in the Event and supersedes all prior discussions or understandings relating to the subject matter herein.

ACKNOWLEDGMENT AND SIGNATURE

I have carefully read this Waiver, understand its contents, understand that I am giving up certain legal rights, and sign it voluntarily.

For Participants Under 18 Years of Age

I am the parent or legal guardian of the minor participant identified above. I consent to the minor's participation in the Event and agree to all terms of this Waiver on behalf of myself and the minor.
